「裁判中にiPhone使うなTwitterするな」

アメリカの地方裁判所のルールとして裁判中に陪審員が、iPhoneやBlackberryなどの電子デバイスや、Twitter、MySpace、YouTubeなどのサービスや、インターネットを利用した検索を行うことが禁止されたそうです。

裁判中にTwitterに内容を書き込んでしまった陪審員が色々いたようですね。 たとえば、ScientificAmericanのニュースブログの2009年3月記事に「Twitter this: Will juror tweeting lead to new trial?」というのがあります。 この記事によると、陪審員が以下のようにTweetしたようです。

"Well, i finally got called for jury duty. It is kinda exciting."
意訳:ついに陪審員として呼ばれた。なんか楽しみだね。

さらに二日後に、次のようにTweetしたようです。

So, Johnathan, what did you do today? Oh, nothing really. I just gave away TWELVE MILLION DOLLARS of somebody else's money!"

意訳:さあ、ジョナサン君、今日は何をしたのかな?まあ、特に。単に1200万ドルもの他人の金をくれてやっただけさ!

"Oh, and nobody buy Stoam. It's bad mojo, and they'll probably cease to exist, now that their wallet is $12M lighter."

意訳:Stoamは買わない方がいいよ。やつらは駄目な麻 薬中毒者だし、今回の件で12Mドル財布が軽くなったから、消えてなくなるよ。

さらに、別件でFacebookとTwitterに裁判の内容を書き込んだとして陪審員から外されるという事件もあったようです。

検索も駄目

U.S. Courtsで公開されている資料には、陪審員が情報を公開することだけではなく、検索などによって関連する情報を調べることも禁止しています。 陪審員は裁判所内で提示された情報だけを使って判断しなくてはならず、家に帰った後も裁判に関連する情報を自分で調査することは禁止されています。

You, as jurors, must decide this case based solely on the evidence presented here within the four walls of this courtroom. This means that during the trial you must not conduct any independent research about this case, the matters in the case, and the individuals or corporations involved in the case. In other words, you should not consult dictionaries or reference materials, search the internet, websites, blogs, or use any other electronic tools to obtain information about this case or to help you decide the case. Please do not try to find out information from any source outside the confines of this courtroom.

それにしても、U.S. Courtsで公開されている文書に掲載されている「駄目なもの」の例が豊富で面白いですね。

I know that many of you use cell phones, Blackberries, the internet and other tools of technology. You also must not talk to anyone about this case or use these tools to communicate electronically with anyone about the case. This includes your family and friends. You may not communicate with anyone about the case on your cell phone, through e-mail, Blackberry, iPhone, text messaging, or on Twitter, through any blog or website, through any internet chat room, or by way of any other social networking websites, including Facebook, My Space, LinkedIn, and YouTube.

TwitterなどのCGMは「公開されるべきではない」とされているものも積極的に公開してしまうということですが、その対処法として登場した今回のアメリカの裁判所の決まりが、今後どのようになっていくか非常に興味があるところです。
